Terms of Use

These terms explain the agreement between you and Elutee when you create an account, save moments or use a paid feature.

Acceptance

By creating an account or using Elutee (the “Service”), you agree to these Terms of Use (“Terms”) and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

Age and eligibility

The Service is intended for people aged 13 or older. You must also be legally permitted to enter this agreement where you live. We may close an account if we learn that it belongs to someone below the applicable age.

Your account

Provide accurate account information and keep your login method secure. You are responsible for activity under your account unless it results from a failure for which Elutee is legally responsible. Contact feedback@elutee.net promptly if you believe someone else has accessed your account.

Your content

You own the text, photos, audio and other material you add to Elutee. To operate and improve the Service, you grant us a worldwide, royalty-free licence to store, back up, process and display that content for you, to provide features you request and as otherwise required by law.

This licence does not transfer ownership to Elutee. It lasts only as long as needed to provide the Service, maintain routine backups or meet a legal obligation. You may delete individual content or your whole account; backup copies disappear through routine rotation.

Using the Service

Elutee grants you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service in accordance with these Terms. Elutee’s software, visual identity, interface and other Service materials remain owned by their respective rights holders. These Terms do not give you the right to copy, resell or commercially exploit the Service.

Acceptable use

Do not use Elutee to break the law, harm or harass others, infringe intellectual-property or privacy rights, distribute malware, interfere with the Service, obtain unauthorized access or misuse automated systems. You must have the rights and permissions needed for content you upload.

We may restrict, suspend or remove accounts or content that violates these rules, while taking account of the circumstances and any mandatory rights that apply.

Notifications

Elutee may send occasional push or email reminders inviting you to add a moment or informing you about the Service. You can turn optional reminders off in your profile or device settings. Service messages needed for security, billing or important legal changes may still be sent.

Third-party services

Elutee relies on external providers for services such as hosting, analytics, AI processing, notifications and payments. Providers processing personal data for Elutee act under our instructions and may not use that data for their own marketing. Apple, Google and other independent services may also apply their own terms to your use of their platforms.

Subscriptions and paid features

Elutee may offer optional paid features through auto-renewable subscriptions. The price, billing period, included features and any trial are shown by Apple or Google before you confirm a purchase. By subscribing, you authorize that platform to charge the displayed fee.

  • Payment is charged to your App Store or Google Play account at confirmation.
  • The subscription renews automatically unless cancelled at least 24 hours before the current period ends.
  • The platform may charge renewal within 24 hours before the current period ends.
  • Elutee does not charge your card directly; Apple or Google handles billing.

Managing and cancelling

You can manage or cancel a subscription through the account settings of the store where you purchased it. Cancellation takes effect at the end of the current paid period and premium access remains available until then.

Deleting is not cancelling

Deleting your Elutee account or uninstalling the app does not cancel a store subscription.

Refunds

Apple or Google handles subscription refunds under its policies. Elutee cannot directly issue, approve or process a store refund.

Where local law gives you a statutory cancellation or refund right, that right continues to apply and the relevant platform administers the process.

Availability and warranties

Elutee is provided “as is” and “as available.” We work to keep the Service reliable but do not promise that it will always be available, uninterrupted or error-free. Features may change, be suspended or differ by platform as the Service develops.

Nothing in these Terms excludes a warranty, remedy or consumer right that cannot lawfully be excluded.

Liability

To the fullest extent allowed by law, Elutee’s total liability arising from the Service or these Terms is limited to €100. This limit does not apply where liability cannot legally be limited or excluded, including mandatory consumer protections and liability for fraud, intentional misconduct or other categories protected by applicable law.

Termination

You may stop using Elutee and delete your account at any time. We may suspend or terminate an account, or discontinue the Service, when reasonably necessary for legal, security or operational reasons, including a material breach of these Terms. Where practicable and lawful, we will provide notice.

Terms that by their nature should continue after termination—including ownership, liability limits and governing law—remain in effect.

Changes to these Terms

We may update these Terms as the Service or law changes. The latest revision date appears at the top. Material changes will be announced in the app or by email before they take effect where required. Continued use after the effective date means you accept the updated Terms.

Governing law and data location

These Terms are governed by Belgian law. Mandatory consumer-protection rules in your country and rights that cannot be waived still apply. Nothing in these Terms removes a right to bring a dispute before a court or body available to you under mandatory law.

Data is primarily stored and processed within the European Union and may also be processed outside the EU with the safeguards described in the Privacy Policy.

Operator and contact

Elutee is currently operated from Belgium by an individual developer under the project name “Elutee.” Legal responsibility rests with that individual until a formal company is formed.
